Land Use – 2/14/2023 Report

The Land Use Committee voted to approve the following (see Report and watch the video on NewTV):

  • Request for an Extension of Time to Exercise a previously approved Special Permit/Site Plan Approval to raze the existing buildings and construct a four-story mixed-use building at 1149-1151 Walnut Street (see Special Permit documents and see recent listing here).
  • Request to construct a second-story addition (allowing a three-story single-family dwelling) and a request to expand an existing garage at 616 Boylston Street (see Special Permit documents and Draft Council Order).
  • Request to amend a previously approved Special Permit/Site Plan Approval to exceed FAR at 336 Cabot Street (see Special Permit documents and Draft Council Order.) NOTE: Inspectional Services determined the FAR was not calculated correctly in the plans approved by the Special Permit. The additions approved by the special permit increases the FAR from .37 to .42 where .38 is the maximum.
  • Request to raze the existing nonconforming three-unit multifamily dwelling and construct a five-unit residential dwelling with ground-level garage parking and associated dimensional, parking, and use waivers at 194 Adams Street (see Special Permit documents and Draft Council Order). NOTE: The petition is changing the current nonconforming 3-unit building into at 5-unit, accessible and all-electric building. Four residents testified expressing concerns related to additional traffic congestion and snow removal. The Committee voted 5-0-3 (Laredo, Lucas, and Markiewicz abstaining).
  • Request to allow a rear-lot subdivision creating two lots and allow a single-family dwelling on each at 176 River Street (see Special Permit documents and Draft Council Order).

The Land Use Committee voted to Deny the following:

  • Request for a change of zone from Multi-Residence 2 to Multi Residence 3 for a parcel of land located at 29 Hunter Street (see Special Permit documents). There is no Draft Denial Council Order.

 The Land Use Committee voted to No Action Necessary for the following:

  • Request to allow a multi-family dwelling, extend nonconforming use, waive parking stalls, and allow dimensional waivers to parking requirements at 29 Hunter Street (see Special Permit documents.) NOTE: A public hearing was held jointly with the Planning and Development Board regarding the Change of Zone request. Three residents testified and expressed concerns regarding parking and reported that there was no outreach to the neighborhood. Committee members cited the impact of rezoning with limited improvements on the neighborhood, noted the lack of outreach to the community, voted to deny the request for a zone change, and voted No Action Necessary on the Special Permit request.
