Land Use Committee Report 9/10/2024

The Land Use Committee approved the following (see Report and watch the Video):

  • Extension of Time to Exercise Special Permit #446-22 at 113 Grove Street (Approved 7-0; Councilor Laredo Not Voting): LLC’s request for an extension of time to November 21, 2024, for a rear lot subdivision to construct a single-family dwelling, relocate the existing dwelling forward, and waive the definition of “rear-lot.”
  • Extension of Time to Exercise Special Permit #227-23 at 107-109 Elliot Street (Approved 7-0; Councilor Laredo Not Voting): LLC’s request for an extension of time to July 10, 2026, to raze the dwelling and construct a four-unit, three-story multi-family dwelling with garage parking for seven vehicles.
  • Extension of Time to Exercise Special Permit #265-23 at 43 Crafts Street (Approved 7-0; Councilor Laredo Not Voting): Kosher K LLC’s request for an extension of time to September 5, 2026, to raze the existing dwelling and construct a three-story, three-unit multi-family dwelling with surface parking for three vehicles.
  • Vertically Extend Nonconforming Side Setback at 228 Grove Street (Approved 7-0; Councilor Laredo Recused; Public Hearing Closed 8-0): David and Ceire Nevins’ request for a special permit/site plan approval to construct a second story addition over an existing sunroom, vertically extending the nonconforming side setback. The plan was approved by the Auburn Historic District Commission. No one spoke at the public hearing. Petition Documents Draft Order
  • Exceed FAR and Vertically Extend Nonconforming Front Setbacks at 35 Hood Street (Approved 8-0; Public Hearing Closed 8-0): Peter Danis’ request to construct basement, first, and second-story additions, exceeding FAR, reconstruct the roof of the detached garage, add a roof deck, and extending the nonconforming front setback of both structures.   • Extend a Nonconforming Front Setback at 98 Parker Avenue (Approved 8-0; Public Hearing Closed 8-0): Alexander Zaslavsky’s request to construct a larger front landing and new steps to improve safety. The Land Use Committee voted to Hold the following:

  • Waive Two Parking Stalls at 15-17 Playstead Road (Held 8-0; Public Hearing Opened): Yanting and Zhen Sun’s request to waive two parking stalls. They plan to convert the current small garage into living space. The Inspectional Services Department had issued a violation for operating an AirBnB without proper registration. Owners stated they had registered as an AirBNB in 2022 and 2023, but forgot to register in 2024. Due to physical constraints of the property large vehicles in the driveway would be in the sidewalk. The item needs to go to the Zoning Board of Appeals to get a variance. At the public hearing 2 neighbors spoke in support, 1 in opposition. Petition Documents
  • Ground Floor Residential Use, and Exceed by Right Height and Stories at 340 River Street and 76 Lexington Street (Held 8-0; Public Hearing Opened): 340 River Street Realty Trust’s request to demolish existing structures, combine lots, and construct four residential dwelling units in one building exceeding the usual height and stories allowed, with discussions focusing on the zoning implications and community impact.
