Land Use – 6/13/2023 Report

The Land Use Committee voted to Approve (see Report and watch NewTV video):

  • Request to allow a second oversized principal sign on the same wall as a secondary sign at 714-724 Beacon Street (6-0) See Special Permit documents and Draft Council Order. Historically there have always been 2 wall signs. Beth Israel Lahey Health Primary Care Clinic.
  • Request to further increase the nonconforming FAR and height at 25 Breamore Road (6-0). See Special Permit documents and Draft Council Order. The addition is for a quadriplegic family member. One neighbor spoke in opposition, concerned about runoff and addition becoming accessory apt if sold. One neighbor spoke for the project.
  • Request for an Administrative Site Plan Review to allow a religious use and a Special Permit to allow a restaurant with more than 50 seats, and associated parking waivers at 1173-1177 Walnut Street (6-0). See Special Permit documents and Draft Council Order. There will be no new structure or internal work and will be located in the basement of the building for New City Church. 6 neighbors spoke in favor. 
  • Request to allow a drive-in business and associated parking waivers, to allow a freestanding sign, and to allow oversized directional signs at 940 Boylston Street (3-2-1, Councilors Lipof and Kelley opposed and Councilor Bowman abstaining). See Special Permit documents and Draft Council Order. This is for the Dunkin Donuts located on Route 9. The project still has to go in front of Massachusetts DOT for an access permit, and they will be denied if they are adding traffic to Route 9. Additionally, stormwater management will be added to the site. Petitioner provided a report to show a relatively zero impact on the environment by changing the store to a drive-through compared to the current use. They will have an employee in a vest from 6AM to 12PM to direct traffic at the front of the store.

The Land Use Committee voted to deny the following:

  • Request to amend the site plan associated with Special Permit #32-21 to allow a curb cut exceeding 20 feet in width at 63-65 Broadway (5-1, Councilor Lucas opposed). See Special Permit documents. Denial Board Order was not posted. A Councilor noted that the special permit that they granted was not followed.
