Land Use – 6/6/2023 Report

The Land Use Committee voted to approve the following (see Report and watch the NewTV video):

  • Request to further extend nonconforming FAR to construct a 16 x 16 sunroom which is not visible from the street at 76 Drumlin Road. No public comments were made. (7-0) See Special Permit documents and Draft Council Order.
  • Request to expand a nonconforming detached garage and construct a half-story addition on an existing detached accessory structure at 231-233 Tremont Street No public comments were made. (7-0). See Special Permit documents and Draft Council Order.

The Land Use Committee voted to hold the following:

The 3 items were discussed together as all dealt with vibration control. According to the report, David Oliveri, the petitioner, stated the “3 projects would have limited vibrations due to no blasting and no pile driving and would have no greater vibrations than the construction of a single-family residence.”

The condition appears to have been implemented as a result of concerns from the Sunrise Senior Living project in Newton Corner where there was reported damage to abutters. There were unresolved issues on the control zone, 150-foot or 250-foot or abutters, or if the insurance fund requirement could be removed because it is no longer required for similar projects. No public comment was accepted at this meeting.

  • Request to raze the existing dwelling and construct four residential units in two buildings with dimensional waivers at 20 Clinton Street. (7-0) to raze the existing dwelling and construct four residential units in two buildings. At the public hearing, a neighbor commented that abutters were happy with the project, especially after changes were made. According to the report, “Request to alter and extend an existing nonconforming side setback was not advertised for. As a result, it will have to be readvertised before the committee can vote. The Newton Historical Commission reviewed the site in February of last year to preserve the home, but it did not pass. Each residential unit has 3 bedrooms, and there is a shared driveway for the structures.” See Special Permit documents.
